I live in California. The reasoning behind this decision is to help the LGBT community feel more inclusive. HOW this actually makes them feels more inclusive is beyond me, but when Californians here anything supportive of the LGBT (even though it's not...) they are all over it like flies on shit. Just include the words, 'equality' 'inclusion' 'tolerance' or similar in any bill and it will automatically pass in California.

Don't get me me wrong knowingly infecting some with HIV is an asshole and immoral thing to do. But correct me if I am wrong, I taught this was an effort to de-criminalize people with HIV. This will in theory encourage more people (straight/gay) to get tested for HIV who are still not aware of their status. If people know they will be criminalized and charged and sent to prison because of knowingly infecting people with HIV (still a shitty thing to do) less people will get tested for HIV because of the surrounding stigma and the potential criminal charges put against them. People who have casual unprotected sex will not be encouraged to get tested, because even if they infect someone, they can just tell the judge in court that they they didn't know they had HIV. The more people having unprotected sex will be like, if I don't know I am infected, the better. If someone finds out they are infected, the medication they are taking will reduce the transmission to other partners significantly.

The reason the penalty was lowered is because the law already had this penalty for knowingly exposing people to disseases that are similar in severity and there was no reason to have the penalty for HIV be extra severe. But make sure to leave that part out and just use the headline OP, that totally makes you look like a rational guy who has no agenda.

The reasoning is simple, $$. If the state willingly convicts aids/HIV infected people the become responsible for their health while incarcerated. Dealing with diseases seriously cuts into profits. Jails are for profit institutions, designed to make obedient citizens (aka slaves), terminal slaves are not profitable.
